Nomi Technologies, a company that tracks cell phones using WiFi, was investigated by the FTC for failing to live up to a promise in its privacy policy to notify consumers and give them an opportunity to opt out when they were being tracked. In reality, the company never told visitors that they were being tracked at all, let alone provided a method to opt out. In order to settle the FTC investigation, Nomi was forced to agree not to misrepresent consumer options and its data collection practice.
